About these terms

These Terms of Use ("these terms") apply to every Dive Kit service: the Dive Kit mobile app ("the App"), this website at divekit.app, shared plan links, the Dive Kit AI connector (the MCP server at mcp.divekit.app) and the Dive Kit command-line tool ("the CLI"). Together we call them "Dive Kit" or "the Services". These terms include the end-user licence agreement for the App.

By downloading, installing, accessing or using any part of Dive Kit, you agree to these terms. If you do not agree, do not use Dive Kit.

Who we are

Dive Kit is provided by Ronny Majani, trading as a sole trader in Australia and registered with an Australian Business Number (ABN) ("we", "us", "our", "the Developer"). These terms are an agreement between you and the Developer.

They are not an agreement with Apple Inc., Google LLC or any of their subsidiaries ("the Platform Providers"). As between the Developer and the Platform Providers, the Developer is solely responsible for the App and its content. See App Store and Google Play for the terms the Platform Providers require.

Warning and disclaimer

Diving can cause serious injury and death. Decompression, mixed-gas and rebreather diving add to that risk.

Dive Kit is a tool for reference, learning and experimenting with dive plans. That covers every part of it: the decompression planner, gas blending, best mix, gas usage, breathing rate, buoyancy and weighting, conversions, shared plans and the AI connector. It is not a dive computer, not a substitute for training, and not medical advice.

Its results come from published research models and our own software. Both can be wrong. The models simplify human physiology, and the research behind them makes no promise of safety: divers have been bent on schedules that followed the model exactly. Software has bugs. We cross-check Dive Kit against other tools and publish the results, and we list known defects in the public changelog. Agreement between tools shows the arithmetic matches. It does not show that a plan, mix or fill is safe.

Use Dive Kit only for dives and gas work you are trained and certified to do. The decompression planner is for divers trained in decompression diving by a recognised agency. Gas blending is for trained blenders. If you are not trained for it, do not use Dive Kit to plan it.

Check every input. Analyse every gas. Compare every result with a second source. Dive the more conservative of your plan and your dive computer. The decision to dive, and the responsibility for it, are yours.

Dive Kit labels some results with words like Safe, Caution and Unsafe, and its help text may call a gas "safe there" or a setting "more accurate". These words describe a calculation, not your safety in the water. "Safe" means a calculated value is within a threshold: a commonly published limit, or one you set yourself. It does not mean the dive, mix or fill is safe for you. "Caution" and "Unsafe" mean the value is near or beyond that threshold.

Dive Kit is provided as is, without warranty of any kind, and you use it at your own risk. To the fullest extent the law allows, we accept no liability for any outcome of using it. The full terms are in the Terms of Use.

Who may use Dive Kit

You may use Dive Kit only if all of the following are true. These are conditions of your permission to use it:

  • You are at least 18 years old, or the age of majority where you live if that is higher.
  • You use each tool only for diving and gas work you are trained and certified to do.
  • You use the decompression planner only if you have been trained in decompression diving by a recognised training agency.
  • You use the gas blending tools only if you are a trained gas blender.

Using Dive Kit outside these conditions is not permitted, and you do so entirely at your own risk.

Assumption of risk

You understand that diving, decompression diving, mixed-gas and rebreather diving, and gas blending carry a risk of serious injury and death, and that this risk exists even when every plan, mix and fill is followed exactly. You choose to take on those risks, including any risk that comes from using or relying on a plan, calculation, lookup or other output from Dive Kit. You agree to rely on your own training, experience and judgement, your dive computer and a second source, and not on Dive Kit alone.

Your licence

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use Dive Kit for your own purposes. For the App, this means use on devices you own or control, as permitted by the applicable Platform Provider's usage rules, including the "Usage Rules" in the Apple Media Services Terms and Conditions. You may not distribute the App or make it available over a network where it could be used by several devices at once.

If you get the App through the Apple App Store, you may also use it on other Apple-branded devices signed in to the same Apple ID, including through Family Sharing or volume purchasing, subject to the applicable usage rules.

You must not:

  • copy, modify, decompile or reverse-engineer Dive Kit, except where the law allows it;
  • interfere with, overload or try to gain unauthorised access to the website, the AI connector or any other part of the Services;
  • present Dive Kit output as coming from a certified instructor, agency or dive computer, or use it to supervise or instruct other divers in place of proper training;
  • use Dive Kit for any unlawful purpose.

Free and premium features

Most of Dive Kit is free. The Deco Planner is a premium feature available by subscription ($4.99 per month, first month free) or a lifetime purchase ($24.99). Purchases are made through the Apple App Store or Google Play and are subject to their terms.

  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Payment is charged to your Apple ID or Google account when you confirm the purchase.
  • You can manage or cancel a subscription in your device's account settings.
  • Refunds are handled by Apple or Google under their policies.

AI connector and CLI

The Dive Kit AI connector is experimental. It can change or stop without notice. AI assistants can misread, round or misreport its results, so check any plan in the Dive Kit app or against a second source before you rely on it. The AI connector returns results from Dive Kit's calculations to an AI assistant that you choose. The assistant, not Dive Kit, decides what to ask, how to read the result and what to write back to you. We do not control the assistant and we are not responsible for any text, summary, advice or plan the assistant generates, including where it misstates a Dive Kit result. Your use of the assistant is governed by its provider's terms.

The CLI runs Dive Kit's calculations on your own computer. Everything in these terms that applies to the App applies to the CLI and its output.

Shared plans

A shared plan link shows a read-only snapshot of a plan as it was computed when it was shared. It is not recomputed, and it may have been made with settings, gases or conservatism that do not suit you. If you receive a plan, treat it as someone else's reference, not as a plan for your dive. If you share a plan, you are responsible for sharing it, and for what the other person does with it; see Indemnity.

Known defects and changes to Dive Kit

We list known defects that affect results in the public changelog, together with the version that fixes them. Check it, and keep Dive Kit up to date. We may change, suspend or remove any part of Dive Kit at any time, including how results are calculated.

We are solely responsible for providing any maintenance and support for the App, as set out in these terms or as required by law. For support, contact hello@divekit.app.

No warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, DIVE KIT AND EVERYTHING IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT DIVE KIT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PLAN, SCHEDULE, CALCULATION, MIX, FILL, LOOKUP OR OTHER OUTPUT IS CORRECT, COMPLETE OR SAFE FOR ANY DIVE OR ANY GAS WORK.

This section does not affect any guarantee or right that the law does not allow us to exclude; see Your consumer rights.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any loss or damage of any kind, including personal injury, illness, death, property damage, loss of data and direct, indirect, incidental, special or consequential loss, arising from or related to your use of, inability to use, or reliance on Dive Kit or any output from it, or any dive or gas work you or anyone else carries out, however it arises (including in negligence), even if we were told it might happen.

To the fullest extent permitted by law, our total aggregate liability to you for all claims relating to Dive Kit is limited to the greater of the amount you paid for Dive Kit in the 12 months before the claim arose and AUD 50.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law.

Your consumer rights

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or under other consumer protection laws where you live that cannot be excluded, restricted or modified. Where the Australian Consumer Law allows us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

Indemnity

To the extent permitted by law, you agree to indemnify us against any claim, loss, liability or cost (including reasonable legal costs) brought by or arising for another person because of a plan, calculation, mix, fill or other Dive Kit result that you shared with them, or applied to them or on their behalf, including by blending or filling gas for them.

App Store and Google Play

These provisions apply to the App as obtained from the Apple App Store or Google Play.

  • Agreement with the Developer only. These terms are between you and the Developer, not the Platform Providers. They are subject to the applicable Platform Provider's terms, including the Apple Media Services Terms and Conditions and the Google Play Terms of Service.
  • Apple's standard EULA. For App Store purchases, your licence is also governed by Apple's Standard End User License Agreement. Where these terms conflict with it for App Store purchases, Apple's agreement controls.
  • Maintenance and support. The Platform Providers have no obligation to provide any maintenance or support for the App.
  • Warranty. If the App fails to conform to any applicable warranty, you may notify the applicable Platform Provider, and it may refund the purchase price (if any). To the maximum extent permitted by law, the Platform Providers have no other warranty obligation for the App.
  • Claims. As between the Developer and the Platform Providers, the Developer, not the Platform Providers, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation. This allocates responsibility between the Developer and the Platform Providers only. It is not an admission of liability to you or anyone else, and it does not reduce the disclaimers and limitations in these terms.
  • Intellectual property claims. If a third party claims that the App or your use of it infringes their intellectual property rights, the Developer, not the Platform Providers, is responsible for the investigation, defence, settlement and discharge of that claim.
  • Export and sanctions. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with any third-party terms that apply when you use the App, such as your mobile data agreement.
  • Third-party beneficiary. The Platform Providers (Apple Inc. and its subsidiaries; Google LLC and its subsidiaries) are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you.

Intellectual property

Dive Kit, including its design, code, content and branding, is owned by Ronny Majani and protected by intellectual property laws. The decompression models it implements, such as Bühlmann ZH-L16C and Erik Baker's gradient factors, are published research and belong to their authors.

Termination

Your licence lasts until you or we end it. It ends automatically if you break these terms or no longer meet the conditions in Who may use Dive Kit. When it ends, you must stop using Dive Kit and delete any copies of the App. The sections on the warning, assumption of risk, warranties, liability, consumer rights, indemnity and governing law continue to apply.

Changes to these terms

These terms are versioned. This is Version 2026-10. When we change them, we publish the new version on this page with a new version number and date. When a change is material, the App asks you to read and accept the new version before you continue using it. For other changes, continuing to use Dive Kit after the new version is published means you accept it.

Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.

If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may be able to bring a claim in the courts there.

If any part of these terms is found unenforceable, it is limited to the extent needed and the rest of these terms continues to apply.
